All rights reserved. ============================================================ PLEASE READ BEFORE USING FANTYZO ============================================================ By downloading, installing, or using the Imagine Foundry Fantyzo Graphics Client ("Fantyzo"), you agree to the terms of this End User License and Usage Agreement. If you do not agree to these terms, do not download, install, or use Fantyzo. ============================================================ 1. WHAT FANTYZO IS ============================================================ Fantyzo is a desktop graphics capture and recording utility provided by Imagine Foundry. Fantyzo is provided FREE OF CHARGE. No purchase, payment, subscription, or activation is required to use Fantyzo. Fantyzo includes functions that may: • Capture a selected portion of your computer screen. • Upload a screenshot to a third-party hosting service. • Copy the resulting sharing URL to your clipboard. • Open the resulting screenshot in your web browser. • Record a selected area of your screen to a local video file. Fantyzo is a software tool. Imagine Foundry does not control what users choose to display on their computers, capture with Fantyzo, or distribute using Fantyzo. ============================================================ 2. USER RESPONSIBILITY FOR CONTENT ============================================================ YOU are responsible for all content that you capture, record, upload, distribute, publish, or share using Fantyzo. You are responsible for ensuring that your use of Fantyzo and all content you process using Fantyzo complies with: • Applicable laws and regulations. • Copyright, trademark, privacy, publicity, and other rights belonging to third parties. • Applicable Second Life rules and policies when your use involves Second Life. • The Terms of Service and Acceptable Use Policy of any third-party hosting service used by Fantyzo. • This Agreement. The fact that Fantyzo is technically capable of capturing, recording, or uploading particular content does not mean that Imagine Foundry authorizes you to possess, capture, upload, publish, or distribute that content. ============================================================ 3. THIRD-PARTY SCREENSHOT HOSTING ============================================================ Fantyzo Screenshot Capture currently uses Catbox as an independent third-party file-hosting service. When Screenshot Capture is used, the selected screenshot is uploaded from the user's computer to the third-party hosting service so that a sharing URL can be returned. Catbox is an independent service. Catbox is not owned, operated, or controlled by Imagine Foundry. Imagine Foundry does not guarantee the availability, retention, performance, policies, security, or continued operation of Catbox or any other third-party service. Use of Catbox is additionally subject to Catbox's own current Terms of Service, Acceptable Use Policy, Privacy Policy, and other applicable policies. Those policies may be changed by Catbox independently of Imagine Foundry. ============================================================ 4. CATBOX CONTENT POLICY ============================================================ The following is a summary provided for user convenience and is NOT a substitute for Catbox's current official Terms of Service and Acceptable Use Policy. CATBOX CURRENTLY ALLOWS: Catbox currently states that NSFW content is allowed, provided that the content does not violate Catbox's other rules. Accordingly, Imagine Foundry does not represent that Catbox is a PG-only hosting service. Imagine Foundry itself maintains a PG-rated brand. Content uploaded independently by users does not represent Imagine Foundry or its standards. CATBOX CURRENTLY PROHIBITS OR RESTRICTS CONTENT AND CONDUCT INCLUDING, BUT NOT LIMITED TO: • Child sexual abuse material / child pornography. • Sexualized depictions of real minors. • Heavy gore. • Viruses, malware, spyware, and other malicious material. • Certain unauthorized copyrighted material, including prohibited full-length television/anime uploads. • Content that infringes another person's intellectual property rights. • Material or conduct that violates applicable law. • Fraudulent, defamatory, or misleading material where prohibited under Catbox's policies. • Extreme acts of violence or terrorist activity, including terrorist propaganda. • Content or conduct that violates another person's privacy or rights. • Abuse, threats, stalking, harassment, or harmful conduct. • Spam and other prohibited unsolicited communications. • Attempts to circumvent Catbox security, authentication, storage restrictions, or other service protections. Catbox may remove prohibited material and may take action against users who violate its policies. CATBOX'S CURRENT POLICIES CONTROL. Because Catbox can change its rules, users are responsible for reviewing and complying with the current Catbox policies whenever they use Catbox through Fantyzo. ============================================================ 5. IMAGINE FOUNDRY DOES NOT REVIEW USER CONTENT ============================================================ Imagine Foundry does not pre-screen, approve, or endorse screenshots or recordings created by Fantyzo users. Fantyzo is not designed to transmit user screenshots to Imagine Foundry for content review or any other purpose. Imagine Foundry does not receive or maintain copies of user screenshots. Screenshot hosting is performed by the applicable third-party hosting service. Local recordings produced by Record Capture remain on the user's computer unless the user independently chooses to distribute or upload them. ============================================================ 6. PROHIBITED USE OF FANTYZO ============================================================ You may not use Fantyzo to knowingly facilitate unlawful or rights-violating activity. Prohibited uses include, but are not limited to: • Creating, possessing, distributing, or facilitating material prohibited by applicable law. • Child sexual abuse or exploitation material. • Sexualized depictions involving real minors. • Non-consensual intimate imagery. • Copyright or other intellectual-property infringement. • Harassment, stalking, threats, or unlawful abuse. • Unlawful disclosure of another person's private information. • Fraud or malicious impersonation. • Malware or other malicious computer content. • Any activity intended to violate the rights, privacy, or safety of another person. Nothing in this section requires Imagine Foundry to inspect or monitor user screenshots or recordings. ============================================================ 7. USER CONTENT DOES NOT REPRESENT IMAGINE FOUNDRY ============================================================ Content captured, recorded, uploaded, published, transmitted, or shared by a Fantyzo user is the responsibility of that user. User-generated content does not represent Imagine Foundry. Use of Fantyzo to create or distribute content does not constitute approval, sponsorship, authorization, or endorsement of that content by Imagine Foundry. The presence of a Fantyzo-generated screenshot URL or the use of Fantyzo software does not imply any association between Imagine Foundry and the subject matter of the user's content. ============================================================ 8. SECOND LIFE ACCOUNTS ============================================================ Fantyzo does not require a Second Life account, and does not connect to or sign in to Second Life. Imagine Foundry does not request or require your Second Life password, email address, display name, inventory, friends list, location, region, or position in order for you to use Fantyzo. Never provide your Second Life password to Imagine Foundry, Fantyzo, or anyone claiming that it is required to obtain or use Fantyzo. ============================================================ 9. THIRD-PARTY SERVICES ============================================================ Third-party services can change, restrict, suspend, or discontinue their services independently of Imagine Foundry. Imagine Foundry cannot guarantee that a third-party service will retain an uploaded screenshot indefinitely or that a previously generated URL will remain available indefinitely. The user remains responsible for complying with the third-party provider's current terms. ============================================================ 10. LICENSE ============================================================ Fantyzo is provided free of charge. Imagine Foundry grants you a free, personal, non-exclusive, non-transferable license to use the Fantyzo software subject to this Agreement. This license does not transfer ownership of the Fantyzo software, source code, Imagine Foundry intellectual property, or associated proprietary systems. Fantyzo is distributed only through official Imagine Foundry sources: the fantyzo.com and imagine-foundry.com websites and the Imagine Foundry store in Second Life. You may not: • Sell, rent, or charge any fee for Fantyzo. • Redistribute, re-upload, or sublicense copies of Fantyzo. • Distribute modified copies of Fantyzo, or present Fantyzo, in whole or in part, as your own product. • Remove or alter Imagine Foundry names, notices, or this Agreement from Fantyzo. ============================================================ 11. TERMINATION ============================================================ Imagine Foundry may terminate your license to use Fantyzo if you use Fantyzo in material violation of this Agreement, subject to applicable law. On termination you must stop using Fantyzo and delete your copies of it. Termination of a Fantyzo license does not control or remove files that have already been transmitted to an independent third-party service. Third-party providers enforce their own policies separately. ============================================================ 12. NO GUARANTEE OF THIRD-PARTY SERVICE ============================================================ Fantyzo depends on software, operating-system components, network services, and/or third-party services that may be outside Imagine Foundry's control. Imagine Foundry therefore cannot guarantee uninterrupted availability of third-party hosting services or permanent availability of files hosted by those services. ============================================================ 13. CHANGES TO THIS AGREEMENT ============================================================ Imagine Foundry may revise this Agreement for future versions of Fantyzo or when reasonably necessary to address changes in the product, applicable requirements, or third-party services. The version supplied with your Fantyzo product should be retained with your product documentation. ============================================================ 14. IMPORTANT DISTINCTION ============================================================ Imagine Foundry is a PG-rated brand. Imagine Foundry's own product demonstrations, documentation, advertising, examples, and official materials are intended to remain PG-rated. This does not mean that Imagine Foundry monitors or controls the independent content created by Fantyzo users. The user is responsible for the user's content. ============================================================ 15. NO WARRANTY ============================================================ FANTYZO IS PROVIDED FREE OF CHARGE, "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMAGINE FOUNDRY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Imagine Foundry does not warrant that Fantyzo will be error-free, uninterrupted, secure, or compatible with your computer, operating system, or other software, or that any screenshot, upload, URL, or recording will be created, retained, or remain available. You use Fantyzo at your own risk. You are responsible for backing up any recordings or other data that are important to you. ============================================================ 16. LIMITATION OF LIABILITY ============================================================ TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMAGINE FOUNDRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, FILES, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE USE OF, OR INABILITY TO USE, FANTYZO OR ANY THIRD-PARTY SERVICE USED BY FANTYZO, EVEN IF IMAGINE FOUNDRY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE FANTYZO IS PROVIDED FREE OF CHARGE, IMAGINE FOUNDRY'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO FANTYZO SHALL NOT EXCEED ZERO U.S. DOLLARS (US$0), TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted by law. ============================================================ 17. ACCEPTANCE ============================================================ BY DOWNLOADING, INSTALLING, OR USING FANTYZO, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO THIS END USER LICENSE AND USAGE AGREEMENT.
